1. Mxit Lifestyle (Pty) Ltd., a private company operating from the La Gratitude Building at 97 Dorp Street in Stellenbosch, South Africa, (hereafter known as “the Organiser”) is organizing a competition referred to as the Mad About Science competition (hereafter called “the Competition”) on behalf of Mxit Reach (hereafter known as the “Promoter”).
2. The name of the Competition is “A long walk to Udubs competition”.
3. The Competition is open to all members of the public who are residents of South Africa and over the age of 13. The Competition is not open to employees and their immediate families of the Organiser or the Promoter, their advertising and promotion agencies, distribution partners, competition sponsors, associated companies, outlet owners and their immediate families and staff. The Organiser reserves the right to verify the eligibility of all entrants.
4. The advertising for the Competition on Mxit will be displayed to the user as such: “Win airtime with our “A long walk to Udubs” competition.”
5. Message displayed to users via Mxit Reach app broadcast message: “Love stories? Read ‘A long walk to Udubs’ on FunDza & answer 5 short questions to stand a chance to win R100 airtime! Go to $Reach$ for info”.
6. Mxit users can access the Competition via a competition contact called: “reach.org”. Entry to the Competition is FREE. Once the users have entered the competition contact, they are requested to fill in their name and mobile number and select the correct answer to the question from an optional list. Only those users who have selected the correct answer will be entered for the draw.
7. The Competition starts on 02 November 2013 and will last until 09 November 2013 (“the Closing Date”).
8. Entries must be received by the Closing Date. Any entries received after the Closing Date and time will be invalid and will not be considered, nor will the Organiser have any obligation with respect to the entrant.
9. The prize will consist of R100 airtime, the winner will select their preferred Service Provider once he/she has been informed of his/her winnings.
10. Winners of the prizes will be selected randomly and the process will be supervised by the Organiser and an independent auditing attorney, Floor Inc. Attorneys. The decision on the final winner will be made by the Organiser. The Organiser’s decision is final and no correspondence will be entered into.
11. The entrants will be responsible for being reachable by telephone at reasonable hours so that the Organiser may contact them. In the event that the Organiser does not manage to contact a winner within 48 (forty eight) hours after the winners have been selected by random draw, the relevant winner will be considered as not having accepted his/her prize. In such an event the Organiser will contact the next winner drawn as a replacement winner. Should the replacement winner not be reached within a further 24 (twenty four) hour period (i.e. within 72 (seventy two) hours after the Closing Date), the Organiser shall repeat the aforementioned process until a winner is reached, allocating a period of 24 (twenty four) hours to reach each successive replacement winner.
12. Once the winners have been selected and notified, the winners will also be announced on Mxit Reach.
13. The Promoter reserves the right to extend, shorten or suspend the time period of the promotional Competition or to nullify it whenever he should so choose for technical, commercial, or operation reasons, or for the greater public good, or due to a “force majeure” or a decision made by a telecommunications, or other carrier or authority that orders the suspension of the operation, or generally for any reason of comparable magnitude as long as he notifies the contestants beforehand in a manner that is expedient according to his best judgment.
14. Winners may be requested to participate in publicity events that arise from the prize and from your participation in the Competition. In addition, the name, picture, videos, and images of the winners may be used for publicity purposes should they consent thereto (without any additional compensation). Such publicity may include the use of the winners’ name, voice, photographs, and film footage, any declaration made in connection with the Competition, the prizes and any information related to the winners that they may provide for the purposes of the Competition. Should a winner not wish to participate in such promotional activities, he/she may decline to do so without any adverse consequences.
15. The prize(s) is/are not transferable and there are no cash alternatives.
16. The Rules may be amended and the prizes substituted by reasonable notification at any time during the Competition, and the amended Rules will be applied and interpreted at the sole discretion of the Promoter and the Organiser.
17. Such altered Rules and/or substituted prizes shall become effective immediately after being altered or on such date as may be determined by the Promoter and the Organiser.
18. No entrants shall have any recourse against the Promoter or the Organiser as a result of the alterations of the Rules or prizes.
19. Prizes will be delivered to the winners as follows: The winner will confirm his/her preferred service provider for the payment of one recharge to the value of R50.
20. Each winner of a prize which is to be couriered to the winner is responsible to provide the Organiser with a suitable physical address where and a time when the winner (or someone else on his/her behalf) will be able to accept delivery of the prize. If a prize could not be successfully delivered to a winner at the address and on the time stipulated by the winner for such delivery within two attempts of the Organiser’s appointed courier company, then the winner will be deemed to have forfeited the prize and the Organiser and Promoter shall select a replacement winner in the same manner as stated above to deliver the prize to.
21. The Promoter and the Organiser bear no responsibility for any delayed nullification, change or substitution, or partial or total inability to execute any of the obligations deriving from the conditions of the event respecting the winners due to “Force Majeure”, including war, acts of terrorism, accident, fire, flood or any other natural disaster, strike or any other political crisis.
22. By entering the Competition the entrants and winners agree that they enter the Competition at their own risk and to indemnify and hold the Promoter and the Organiser harmless against any claims arising out of damages, including physical damages and death, caused by or to such entrant/winner during the entire duration of the Competition.
23. The Promoter and the Organiser bear no responsibility with regard to the quality, appropriateness and/or use of the prizes.
24. In the event that any dispute should arise regarding the Competition, it will be settled by an appropriate South African court.
25. In the event that any part of these Rules is deemed by a court of competent jurisdiction or by any authorised authority to be invalid, illegal or unnecessary, then the relevant part will not be applied and will be considered invalid while the said Rules will continue to be valid and in force to the greatest allowable degree by law.
26. All the personal information that will be given during the period of participation in the Competition will be protected in accordance with South African Law and the Promoter and Organiser’s respective Privacy Policies as available on www.mxit.com.
27. The Promoter and the Organiser shall keep all entrants’ personal information safe and confidential. The Organiser will not keep/use your personal information for any purpose other than the Competition. The Organiser will not sell or transfer your personal information to any third party, except to the Promoter and/or its affiliates or agents, without your express consent.
28. By submitting your data when entering the Competition you give your consent to the Promoter and/or Organiser as data controller(s) to collect and process your personal data for the purposes of the Competition.
